Denpasar — Bali Governor Wayan Koster said the provincial government will appeal a Denpasar Administrative Court ruling that sided with the investor behind the proposed Kelingking Beach glass lift in Nusa Penida, according to Bali News and local reporting. The appeal was expected to be filed within 14 days of the verdict, which was issued on 3 September 2026.
The case, registered as No. 17/G/2026/PTUN.DPS, was reported to have been decided in favour of PT Indonesia Kaishi Tourism Property Investment Development Group, the company linked to the project. Reporting from multiple local outlets said the court granted the investor’s lawsuit in full and ordered the provincial action that had been challenged to be cancelled.
Koster said the province disagreed with the ruling and was preparing its appeal, including arguments about whether the approved building permit matched the full scope of the proposed development. Local reports quoted him as saying the permit covered only about five ares, or 500 square metres, for a ticketing area, while the project description also referred to a bridge and a lift spanning about 800 metres.
Dispute over permit scope
The provincial government’s position is that the disputed approval did not cover the larger structure that has stirred concern over the cliffside site at Kelingking Beach. Local reporting said Bali officials were also examining environmental and coastal impact issues as they prepared the next stage of the case.
DPRD Bali chairman Dewa Made Mahayadnya said the legislature supported the appeal, while stressing that spatial planning, licensing and environmental safeguards needed to be considered together, according to local reporting.
The ruling is an important early step in the administrative dispute, but the case is not over. Under the reported timeline, both sides had a 14-day window to seek appeal after the judgment was delivered.
Background
The Kelingking Beach proposal has drawn scrutiny because of its location on one of Bali’s most recognisable coastal landmarks and the scale of the planned infrastructure. The court case concerns an administrative action by Bali’s Satpol PP, not a blanket approval for all construction at the site.
Local reports said the first-instance decision did not settle every permit issue tied to the project, including whether other spatial, environmental and operational approvals are in place. The appeal is expected to test those questions further before the next judicial stage.
