Swiss tourist handed one-year Bali jail term over Nyepi Instagram posts

Denpasar — A Swiss tourist has been sentenced to one year in prison in Bali for insulting Nyepi, the island’s Hindu Day of Silence, in social media posts that showed him violating the holiday’s restrictions and disparaging the observance, according to court officials and media reports.

Reports from Denpasar district court and international media identify the defendant as Luzian Andrin Zgraggen, a 26-year-old construction worker from Switzerland. He was convicted last month under provisions of Indonesia’s new criminal code related to insulting a religious observance and online hate speech.

Nyepi rules and the offending posts

Nyepi, Bali’s Day of Silence marking the Balinese New Year, requires residents and visitors to stay indoors, keep noise to a minimum and refrain from work and entertainment for 24 hours. Public spaces, including streets and beaches, are largely deserted, and authorities conduct patrols to monitor compliance.

Media reports say Zgraggen had been informed of Nyepi rules by hotel staff before the holiday, but nonetheless filmed himself heading to the beach and posted the video on Instagram with a caption containing an expletive directed at Nyepi and its rules. The video circulated widely and triggered complaints from Balinese residents, prompting police to open an investigation.

Zgraggen was arrested in March 2026 in the Legian area after the posts drew widespread condemnation. He was later charged under Indonesia’s new penal code, including an article on insulting a religious observance and provisions covering hate speech disseminated via information technology, which carry a maximum sentence of up to five years’ imprisonment.

Trial, sentence and detention credit

During his trial at Denpasar District Court, Zgraggen expressed regret and apologized, telling judges he had been frustrated during Nyepi but said he did not intend to insult Balinese people or Hinduism, according to news reports quoting court officials. Prosecutors sought a 15-month prison term. The judges instead imposed a one-year sentence, citing his cooperation in court, lack of prior offenses and the fact that it was his first visit to Bali.

Media reports and court statements indicate that Zgraggen had already spent about five months in pre-trial detention following his March arrest. That time will be deducted from his one-year term, meaning he is expected to serve the remaining seven months in prison, subject to any further legal appeals or sentence reductions available under Indonesian law.
